US Court Mandates Freedom of Abrego Garcia from ICE Custody
A federal judge has ruled the prompt discharge of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing detainment lacks legal authority.
"Since Abrego Garcia's return from wrongful detention in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis wrote in her order.
The situation originates in a mistaken removal to El Salvador in March, which US authorities later acknowledged was an mistake. After his repatriation to the United States to face human smuggling charges, he was held in federal custody.
In her decision, the court pointed out that the government does not have a valid removal order, which prevents them from deporting Mr. Abrego Garcia "at this time."
